Resumen:
La discusión acerca de quién debe ser el defensor de la Constitución, es una cuestión clásica en la justicia constitucional tan importante como la pregunta acerca de cómo debe actuar dicho defensor. En el presente artículo se pretende abordar la pregunta acerca de si es posible prescindir de la tesis de la discrecionalidad en la justicia constitucional. Para tal propósito se efectúa una revisión de la discusión entre KelsenHart, para luego realizar una evaluación de la tesis de la discrecionalidad judicial frente a las teorías principialistas de Dworkin y Alexy sobre el derecho y sobre cómo debe actuar el defensor de la Constitución.
The discussion about who should be the defender of the Constitution is a classic question in constitutional justice as important as the question about how should act that defender. This article aims to address the question of whether it is possible to dispense with the thesis of discretion in constitutional justice. For this purpose, a review of the discussion between KelsenHart is done, to then carry out an evaluation of the thesis of judicial discretion against the principlist theories of Dworkin and Alexy about the law and on how the defender of the Constitution should act.
A discussão sobre quem deve ser o defensor da Constituição é uma questão clássica na justiça constitucional tão importante quanto a questão de como deve agir esse defensor. Este artigo visa abordar a questão de saber se é possível prescindir da tese da discricionariedade na justiça constitucional. Para tanto, é realizada uma revisão da discussão entre KelsenHart, para então realizar uma avaliação da tese da discricionariedade judicial frente às teorias principialistas de Dworkin e Alexy sobre o direito e sobre como o defensor da Constituição deve agir.
