Rasgos epistemológicos de la concepción de “hecho” en la obra de Michele Taruffo
Resumen:
La presente tesis busca exponer el concepto de “hechos” en el derecho que el procesalista y filósofo del derecho italiano Michele Taruffo sostuvo a lo largo de toda su prolífica obra, para luego contrastarlo con las siguientes corrientes filosóficas: el idealismo trascendental de Immanuel Kant, el atomismo lógico de Bertrand Russell, la filosofía hermenéutica de Hans-Georg Gadamer y el neopragmatismo de Susan Haack, buscando explicitar los rasgos epistemológicos del concepto inicialmente mencionado.
This thesis seeks to present the concept of "facts" in law that the Italian proceduralist and philosopher of law Michele Taruffo maintained throughout his prolific work, and then contrast it with the following philosophical currents: the transcendental idealism of Immanuel Kant, the logical atomism of Bertrand Russell, the hermeneutic philosophy of Hans-Georg Gadamer and the neopragmatism of Susan Haack, seeking to explain the epistemological features of the concept initially mentioned.
