Novo constitucionalismo na América Latina: Perspectivas epistemológicas
Resumen:
El presente escrito tiene como objetivo comparar dos modelos de estudio del derecho: el occidental y el latinoamericano, en torno a conceptos, de manera muy general y abstracta, como el Derecho y el Poder. Para ello el texto estará dividido en tres partes: (1) un esbozo general de la teoría de la interpretación jurídica, 1.1) pasando a la teoría de la constitución, (2) para luego plantear, de manera muy breve, los postulados generales –de lo que hemos llamado, por cuestiones teóricas–del “Constitucionalismo del Sur”, y al final, y (3) un análisis comparativo entre los dos esquemas mencionados, marcando las similitudes, pero sobre todo, intentando denotar y marcar las asimetrías y “rupturas epistémicas” con base en los conceptos de derecho y poder.
This papers has as aim to compare two models of study of the right: the western one and the Latin American, concerning(around) concepts like the State, the Law and the Power. For it the text will be divided in three parts(reports): (1) A general sketch of the theory of the juridical interpretation, 1.1) going on to the theory of the constitution, (2) then to raise, in a very brief way, the general postulates - of what we have called, for theoretical questions - of the “ Constitutionalism of the South “, and ultimately, and (3) a comparative analysis between(among) both mentioned schemes, marking the similarities, but especially, trying to denote and to mark the asymmetries and Theoretical detachments with base in the concepts of condition (state), right and power.
O objetivo deste artigo é comparar dois modelos de estudo de direito: ocidentais e latino-americanos, em torno de conceitos, de maneira muito geral e abstrata, como o Direito e o Poder. Para este fim, o texto será dividido em três partes: (1) um esboço geral da teoria da interpretação legal, 1.1) passando para a teoria da constituição, (2) para então apresentar, muito brevemente, os postulados gerais - do que que chamamos, por razões teóricas - “Constitucionalismo do Sul”, e no final, e (3) uma análise comparativa entre os dois esquemas mencionados, marcando as semelhanças, mas acima de tudo, tentando denotar e marcar as assimetrias e “rupturas epistêmicas”. com base nos conceitos de lei e poder.
