Este artículo analiza la persecución política de las disidencias sexo-genéricas en Uruguay a partir de la función ideológica del archivo jurídico-policial. Se sostiene que el decreto 630/980 vigente hasta 1999 funcionó como un dispositivo de exclusión que articuló derecho, moral y represión estatal en torno a la figura del “pederasta”, inscribiendo a las mujeres trans como amenazas ontológicas. La hipótesis central afirma que esta gramática clasificatoria se prefiguró en discursos médico-legales y crónicas periodísticas del siglo XX, especialmente en el relato de Soiza Reilly. Desde allí, el artículo propone una lectura contra archivística de gestos literarios disidentes como los de Pedro Lemebel, que interrumpen la clausura del archivo ideológico y activan memorias no autorizadas. Se articula un enfoque crítico desde el cruce entre derecho y literatura que tensiona la lógica jurídica moderna, iluminando sus exclusiones constitutivas

This paper examines the political persecution of sex-gender dissidence in Uruguay through the ideological function of the legal-police archive. It argues that Decree 630/980 —in force until 1999— operated as an exclusionary device, articulating law, morality, and state repression around the figure of the “pederast,” inscribing trans women as ontological threats. The central hypothesis holds that this classificatory grammar was prefigured in early 20 th Century medico-legal discourse and journalistic chronicles, particularly in Soiza Reilly’s narratives. This paper proposes a counter-archival reading of dissident literary gestures—such as those of Pedro Lemebel—that interrupt the closure of the ideological archive and activate unauthorized memories. A critical framework at the intersection of law and literature is articulated, revealing the constitutive exclusions of modern legal rationality.
