La discriminación, la re-victimización y la impunidad en la respuesta del poder judicial a casos concretos de violencia de género han sido identificados en relación al acceso a la justicia de las mujeres víctimas de la violencia en las Américas (CIDH, 2007). Las investigaciones señalan que las mujeres, niños, niñas y adolescentes se hallan en alto riesgo de morir en manos de sus agresores cuando denuncian la violencia y/o piden medidas de protección, o durante las visitas paterno-filial. El Poder Judicial enfrenta en estos casos una alta responsabilidad ética y jurídica de velar por la protección de quienes denuncian. Por otra parte, la Declaración de Naciones Unidas sobre Víctimas de Delitos (1985) y las Reglas de Brasilia (2008) señalan que las mujeres, niños/as víctimas de violencia de género que requieren especial protección, y la Convención Interamericana Belén Dó Pará establece obligaciones concretas al Poder Judicial. El presente artículo aborda el rol del Poder Judicial en América Latina en su respuesta a casos debidos a violencia basada en el género, y partiendo del modelo propuesto por Ptacek (1999) y que hemos adaptado a nuestra realidad regional, sugiriendo respuestas que empoderan a las mujeres y sus hijos/as, a fin de obtener protección y salir de ésta.

Discrimination, re-victimization and impunity in the judiciary´s response to specific cases of gender-based violence have been identified in relation to the access to justice women who are victims of violence in the American continent have (IACHR, 2007). Research shows that women, children and adolescents are at high risk of dying at the hands of their assailants when they report violence and/or request measures of protection, or during father-child visitation. The Judicial Power has a high ethical and judicial responsibility to safeguard the victims who report violence. Furthermore, the United Nations Declaration of Basic Principles of Justice for Victims of Crime (1985) and the Brasilia Regulations (2008) point out that women and children who are victims of gender-based violence require special protection, and the Inter-American Convention of Belem Do Para establishes specific responsibilities for the Judicial Power. This article addresses the role of the Judiciary in Latin America regarding cases of gender-based violence, and based on the Ptacek model (1999) adapted to our regional reality. The article proposes judicial responses to empower women and their children, thus obtaining protection and escaping said reality.
