Resumen:
Este trabalho tem por objetivo analisar as questões constitucionais que ocorreram na segunda metade do século XIX, a exemplo da “questão religiosa”, “questão militar” e “abolição da escravatura”, que levaram ao fim do regime monárquico no Brasil. Iremos tratar do panorama histórico da época, a ordem jurídica vigente e as crises constitucionais do Império, onde analisaremos a Constituição de 1824 e seus artigos que abordam da divisão dos poderes e das funções concernentes ao Poder Moderador. Analisaremos todas essas questões através da visão de Machado de Assis refletida nos personagens dos contos “Fulano” e “Um homem célebre”, sob um ponto de vista interdisciplinar entre o Direito e a Literatura.
This article will examine the constitutional issues that occurred in the second half of the nineteenth century, such as the “religious issue”, “military issue” and “abolition of slavery”, which led to the end of the monarchy in Brazil. We will treat the historical panorama of the time, the current legal and constitutional crises of the Empire, where we analyze the 1824 Constitution and its articles that discuss the division of powers and functions concerning the moderating power. Analyze all these issues by Machado de Assis vision reflected in the characters of the stories “Fulano” and “Um homem célebre”, under an interdisciplinary method, targeting the relations between Law and Literature.
