Algunas precisiones sobre la suspensión del concurso de acreedores en el Derecho uruguayo

El propósito del presente artículo es realizar una crítica constructiva del actual régimen de suspensión del concurso de acreedores regulado en la Ley Nº 18.387 de Declaración Judicial del Concurso y Reorganización Empresarial (LCU). Extraída casi en forma literal de los arts. 243 a 248 de la Propuesta de Anteproyecto de Ley Concursal española de 1996 (PALC), que nunca vio la luz como lo que pretendió ser, se trata de una regulación que ha sido ampliamente superada por la redacción definitiva de la actual Ley 22/2003 de 9 de julio Concursal española (LCE). Sin embargo, nuestro legislador, por razones que desconocemos, ha optado por mantener su apego a la PALC, en lugar de aprovechar las mejoras técnicas introducidas en el texto definitivo de la LCE.

The purpose of this paper is to offer constructive criticism of the current regime of the suspension of bankruptcy proceedings in Uruguay, regulated by Law No. 18,387 (Uruguayan Insolvency Act, 2008). Taken almost literally from the Spanish Proposed Draft of Insolvency Act (SPDIA, 1996), which never saw the light as it claimed to be, this regulation has been largely superseded by the final wording of the current Spanish Insolvency Act 22/2003 of July 9th (SIA). However, for some reason that we ignore, our legislator has chosen to maintain its adherence to the SPDIA, rather than take advantage of the technical improvements introduced by the drafters of the SIA.
