Damage as the principal element for the exigency of civil reponsability caused by crime
Resumen:
La perspectiva estructural que se sigue con la investigación, parte de sugerentes cuestiones sobre el daño como eje central dentro de la responsabilidad civil derivada del delito; así como de la naturaleza y funciones de la obligación civil ex delito, teniendo en cuenta tres hipótesis fundamentales que abordan tanto su naturaleza puramente civil, hasta valorarla como perteneciente a la materia penal, concluyendo con el análisis de la esencia mixta de la institución, en base a fundamentos políticos- sociales, de la imposición sancionadora que logra la satisfacción del perjudicado-acreedor, al venir impuesta por el ordenamiento jurídico frente a un daño que confirma la interrelación de los elementos sobre la causa efficiens y la causa finalis de la obligación específica, que parte de una relación jurídica funcionalmente organizada.
The structural perspective that is followed with the investigation, part of the suggestive matters about damage as the central axle of the civil responsibility produce from crime, just like the nature and the functions of the excrime civil obligation, taking into account three fundamental hypothesis that aboard its pure civil nature as also a valuation as a criminal matter, concluding with the analysis of a mix essence of the institution, in base of the social and political bases of the punishment impositions that accomplishes the victims satisfaction, with the juridical codification imposition in front of a damage that confirms the interrelation of the efficiens cause and the finalis cause elements of the specific obligation, which birth from a functional organize juridical relation.
