Sumario:Education qualification can be considered important for the democratic management of education, since it has in mind a human development aimed at not only the emancipation of those involved in it but also the transformation of relationships. This study seeks to understand how the democratic management of education has been presented in the Brazilian national educational legislation, starting with the Federal Constitution of 1988. Therefore, the qualitative research, carried out with documentary research, reached the conclusion that the democratization of educational management achieved centrality in Brazilian education in the 1980s, being standardized and materialized in 1988, with the introduction of the democratic management principle in the form of the Law in the 1988 Federal Constitution, and reaffirmed in the subsequent regulation. It consists of important progress, as it establishes democratic management as the concept that must prevail in Brazilian education. However, it does not define how this management should be implemented. Also, it presents the concept associated with strategic planning, merit criteria, educational performance, and the search for educational results in the PNE (2014-2024).
