Sumario: | Abstract. For approximately over a decade there is an insistence in our country on a number of proposals that involve setting limits on the autonomy of the will, to move towards a more balanced and fair contracting; analyzing the effect of the constitutional principle of equality on private autonomy in contracting and reviewing a contractual equation in times of economic emergency. We will attempt to lear this thought developed mainly by Prof. Juan Blengio and contrast it with our own view of the contract –law between the parties- and with the principle of autonomy of the will. We will start from the premise shown by the title of the work: the contract, an essential tool of economy and trade in particular, has a need for self-contractors regulating their property legal relations. The contract requires freedom in the formation and implementation. Even withthe best intentions, a third party cannot and should not enter it, altering the will of the parties. |
