| Sumario: | Abstract: This paper is the result of new reflections on an old theme, which relates several cornerstones of the proof theory and activity of sentencing. The author tries to determine the steps that you must follow the Court to determine the existence or nonexistence of the facts constituting the object of the test and returns to inquire about the essential foundations of the rule of the burden of proof and the need for it to default normatively. |
