Sumario:The present constitutes the final external work for the course of philosophy of the law and consists, basically, in the analysis of the argumentation and juridical interpretation wielded by the integrated majority of the Court of Civil appeals of 6th shift in the Sentence N ° 37/1996. As well as the employee in the discord of one of its natural members. No other element linked to the judgement that might be of interest in the particular case, such as the factual basis on which the pronouncement or appraisal of the test carried out by each minister, shall be subject to study. These elements will be given for assumptions.
