Sumario: | Abstract. The civil liability doctrine of the State legislative has its origin in French jurisprudence. Several legal systems have included said concept since the times of therenowned Arrêt de La Fleurette. The legal systems of France and Spain have exertedconsiderable influence on a Chilean simile. This article deals with some representativeelements of the liability theory of State legislative in the European systems already mentioned,specially in the doctrine and legal framework, and looks for similarities with the Chilean case. |
