dc.description.en-US.fl_txt_mv This article discusses the merits of the exception of non-performance in the field of administrative law, issue on which both national doctrine and the “Tribunal de lo Contencioso Administrativo” (Court of Administrative Litigation Law) show dissimilar positions. The most recent judgments of that Court reject the application of the exceptio non adimpleti contractus, considering that the failure of the public agency does not authorize the contractor not complying with its obligations. In disagreement with the position of the Court, we estimate that it must be allowed, as a general rule, the operation of the institute in the field of public contracts, provided that certain conditions are observed. This because the breach of the public agency operates as a justification and consequently eliminates the illegality of the failure of the contractor. Consequently, the administrative act of unilateral termination of the contract, which is based on a breach of the contractor that is justified by the failure of the counterparty, it is unlawful for being flawed in their motives.
dc.description.es-ES.fl_txt_mv El presente artículo analiza la procedencia de la excepción de contrato no cumplido en el ámbito del derecho administrativo, cuestión sobre la cual se evidencian posiciones disímiles tanto en la doctrina nacional como en la jurisprudencia del Tribunal de lo Contencioso Administrativo. Las sentencias más recientes del citado Tribunal rechazan la aplicación de la exceptio non adimpleti contractus, considerando que el incumplimiento de la Administración no legitima al co-contratante para incumplir sus obligaciones. En discordancia con la posición de la Corporación, estimamos que debe admitirse de regla la operatividad del instituto en el campo de la contratación administrativa, siempre que se verifiquen determinados requisitos. Ello por cuanto la falta de cumplimiento de la Administración opera como causa de justificación y en consecuencia enerva la ilegitimidad del incumplimiento del co-contratante. En consecuencia, resultará ilegítimo, por estar viciado en sus motivos, el acto administrativo de rescisión unilateral del contrato que se funde en un incumplimiento del contratista que esté justificado por la inejecución de la contraparte.
