The article analyzes the judgment of the Inter-American Court of Human Rightson the case “Almonacid Arellano”, where it was decided that (a) although the Chileandeclaration acknowledging the competence of the Inter-American Court by “operation of law” referred to facts subsequent to the date the ratification instrument was submitted, the unilateral act of any state is conditioned by the Convention itself as a whole and cannot be subject to objections; and (b) Chile infringed the general duties pursuant to articles 1.1 and 2 of the American Convention on Human Rights (the duty to respect the rights and the duty to adopt decisions of domestic law). Upon the analysis of both aspects mentioned, the legitimacy of Decree Law 2191 is studied in respect of its maintenance as well as its adoption, laying special emphasis on all relevant aspects of the matter. The article ends with a reflection on the legal nature of human rights’ international regulations in Chile and the annulment of the Amnesty Decree Law, concluding that any court which deems that the law does not adjust to the constitutional block of human rights, may and must request the Constitutional Court to pronounce on the inapplicability of the legal precept. |

Se analiza la sentencia de la Corte Interamericana de Derechos Humanos en elcaso Almonacid Arellano, en el cual se decidió que: a) pese a que la declaración chilena dereconocimiento de “pleno derecho” de la competencia de la Corte Interamericana referíaa hechos posteriores a la fecha del depósito del instrumento de ratificación, el acto unilateralde cada Estado está condicionado por la propia Convención como un todo y no puedeser objeto de reservas, y b) que Chile incumplió los deberes generales contenidos en losartículos 1.1 y 2 de la Convención Americana de Derechos Humanos (obligación derespetar los derechos y obligación de adoptar decisiones de derecho interno). Luego deanalizar los dos aspectos señalados se estudia la legitimidad del decreto ley 2191, tantopor su mantenimiento como por su aplicación, con detenimiento en todos los aspectosrelevantes de la cuestión. El artículo culmina con una reflexión sobre la naturaleza jurídicade las normas internacionales de derechos humanos en Chile y la nulidad del Decreto Leyde Amnistía, y concluye que cualquier tribunal que considere que la ley no se ajusta albloque constitucional de los derechos humanos puede y debe pedir al Tribunal Constitucionalque se pronuncie sobre la inaplicabilidad del precepto legal. |
