In the Argentine Republic, although there does not exist an express legal text, the doctrine and the case law have almost unanimously declared themselves in favor of the idea that the condominium of owners of propiedad horizontal is a legal person different from the members forming it. Amendment proposals since the last quarter of the 20th century correct this lack by establishing – whether implicitly or expressly – the legal capacity of the condominium. In light of that the problem of how members of the condominium answer for its debts remains. Despite the reiteration of the issue, no legislative solution has been given to it, which gives rise to the elaboration of different theories by the doctrine. Strangely, the project to unify the Civil and the Commercial Codes, from 2012, does not give an answer to this last question either. |

En la República Argentina, pese a la ausencia de un texto legal expreso, la doctrina y la jurisprudencia en forma casi unánime se han pronunciado por que el consorcio de propietarios de propiedad horizontal es una persona jurídica distinta a los miembros que lo integran. Los proyectos de reforma desde el último cuarto del siglo XXsubsanan esto consagrando en forma implícita o expresa la personalidad del consorcio. Ante ello resta el problema de cómo responden los consorcistas por las deudas de aquel. Pese a lo reiterado del planteo, no se le ha brindado una solución legislativa, lo que da lugar a que la doctrina elabore distintas teorías. El proyecto de unificación de los Códigos Civil y Comercial, del año 2012, extrañamente, tampoco da una respuesta a este último interrogante. |
