dc.description.en-US.fl_txt_mv | This article analyzes the solutions provided by criminal law to public health emergencies and the proposals caused by the COVID-19 pandemic. To this end, first, we present a historical review of health emergencies that led to criminal rules to punish the transmission of diseases. Then, in the context of the current pandemic, we analyze the proposed modification of the crime of violation of sanitary provisions (Article 224 of the Penal Code). Among the conclusions, it is highlighted that the legislative proposal attempts to resort to penal norms to solve an extra-criminal problem and that the criminalization of these conducts does not contribute to the protection of public health. |
dc.description.es-ES.fl_txt_mv | El presente artículo analiza las soluciones dadas por el Derecho Penal ante emergencias de salud pública y, en particular, a las propuestas ocasionadas por la pandemia de COVID-19. Para ello, en primer lugar, se presenta un repaso histórico por situaciones de emergencia sanitaria que desembocaron en normas penales de castigo a la transmisión de enfermedades. Luego, y ya en el marco de la actual pandemia, se analiza la propuesta de modificación del delito de violación a las disposiciones sanitarias (artículo 224 del Código Penal). Entre las conclusiones se destaca que la propuesta legislativa intenta recurrir a normas penales para solucionar un problema extra penal y que la criminalización de estas conductas no contribuye a la protección de la salud pública. |
