dc.description.en-US.fl_txt_mv | Abstract. The dogmatic orientation of the secret as an institution is generally fully definedfrom the theory referred to as the theory of the spheres. This modern working paradigmenables us to pinpoint the various manifestations of intimacy/privacy in concentric spheresof progressively larger radius, inversely related to the intensity of their protection: the individual sphere, the private sphere, the trust sphere and, lastly, the secret sphere, consubstantially related to what freedom essentially is. This essential view of the secretmust be expressed through its dogmatic concept, and due to natural derivation, through the variety of its structural elements; classically: relative subjectivism, current situation, legal relevance and relativism. A fifth element is put forward, the statutory one, which turns this institution into a right-obligation system with certain guarantees. The Uruguayan banking secrecy is analyzed so as to prove the usefulness of said proposal, enabling us to visualize the relevance of the legislation and the limits of the active legitimization of the debtor whose secrecy is kept, as well as the procedural means to make it effective. |

Este moderno paradigma de trabajo permiteubicar tomográficamente las distintas manifestaciones de la intimidad/privacidad en esferasconcéntricas de radio progresivamente mayor, en relación inversa a la intensidad de suprotección: la esfera de lo individual, la esfera privada, la esfera de confianza y por últimola del secreto, que se consustancia con lo medular de la libertad. Esta visión medular delsecreto debe traducirse en su concepto dogmático y por natural derivación en el elenco desus elementos estructurales; clásicamente: subjetivismo relativizado, actualidad, relevanciajurídica y relativismo. Se propone un quinto elemento, el estatutario, que transforma alinstituto en un sistema de derecho-deber en clave de garantías. A efectos de demostrar lautilidad de tal propuesta se recurre al análisis del secreto bancario uruguayo, que permitevisualizar la pertinencia normativa y los límites de la legitimación activa del deudor delsecreto, así como los medios procesales para hacerla efectiva. |
