El proceso de institucionalización del Trabajo Social en el Poder Judicial uruguayo (1970-1998)

Resumen:
La presente investigación se refiere al proceso de institucionalización de la profesión en el Poder Judicial en Uruguay en la segundamitad del siglo XX, en el marco de un Estado que intervenía fuertemente y regulaba la vida social, en un contexto regional en el cual el desarrollo del capitalismo, junto con el tratamiento dado a la “cuestión social”, demandaba nuevas profesiones que ofrecieran respuestas. Dado que el estado del arte da cuenta de la inexistencia de trabajos académicos sobre el tema, se procura establecer cuáles fueron las condiciones sociohistóricas e institucionales que contribuyeron a dicho proceso. Se plantearon objetivos que permitieran reconstruir, describir, caracterizar y analizar ese proceso, identificando, dentro de la división social y técnica del trabajo, el lugar ocupado por la profesión en el campo jurídico. La indagación procura comprobar que la inserción de la profesión en el Poder Judicial adquirió su propia impronta, aunque respondió al contexto de la medicalización de la sociedad, orientada al control y la normalización de la vida cotidiana. A esto se suma el hecho de que en las sociedades contemporáneas se verifica una interferencia creciente del derecho en la vida diaria de las personas. Los profesionales de Trabajo Social, desde los dispositivos de salud y desde el entonces Consejo del Niño, al atender a la “minoridad”, establecieron vínculos con los estrados judiciales que les permitieron ser reconocidos por sus saberes y competencias. Fueron integrados a la institución para realizar las tareas que hasta entonces cumplían los funcionarios administrativos, a quienes terminaron por sustituir. La metodología utilizada es cualitativa, recurriendo a técnicas como la entrevista y el análisis de fuentes documentales. Los resultados obtenidos permitieron, por un lado, reconstruir el proceso de institucionalización con la mayor precisión posible, y se dieron hallazgos que permitieron esclarecer y corregir información que, durante mucho tiempo, se había considerado válida, proporcionando certeza sobre determinados hitos del proceso. Por otro lado, se encontró una explicación para la institucionalización tardía de la profesión en el ámbito jurídico. Finalmente, se establecen algunas reflexiones y líneas de investigación a seguir en el futuro.
This research refers to the process of institutionalizing the profession within the Judiciary in Uruguay during the first half of the 20th century, within the framework of a state that was heavily intervening and regulating social life. This occurred in a regional context where the development of capitalism, along with the treatment of the“social question”,demanded new professions to provide solutions. Given that the state of the art shows the absence of academic works on this subject, the research seeks to establish the socio-historical and institutional conditions that contributed to this process. The objectives were set to reconstruct, describe, characterize, and analyze this process, identifying, within the social and technical division of labor, the position of the profession in the legal field. The investigation aims to demonstrate that the integration of the profession into the Judiciary acquired its own unique traits, although it responded to the context of the medicalization of society, aimed at controlling and normalizing daily life. This is compounded by the fact that, in contemporary societies, there is an increasing interference of law in people's daily lives. Social Work professionals, through health-related mechanisms and from the then Children's Council, addressing issues of“minors”,established ties with the courts that allowed them to be recognized for their knowledge and skills. They were integrated into the institution to perform tasks that had previously been carried out by administrative staff, whom they eventually replaced. The methodology used is qualitative, employing techniques such as interviews and documentary source analysis. The results obtained allowed, on one hand, the reconstruction of the institutionalization process as accurately as possible, revealing findings that clarified and corrected information that had long been considered valid, providing certainty regarding specific milestones of the process. On the other hand, it provided an explanation for the delayed institutionalization of the profession in the legal field. Finally, some reflections and potential lines of future research are proposed.
