Resumen:

En su reciente fallo en el caso “Aplicación de la Convención para la prevención y el castigo del delito de Genocidio”2, la Corte Internacional de Justicia deja pasar una oportunidad histórica para ampliar el margen de apreciación respecto de la protección de la persona y de la Humanidad. La Corte consolida una interpretación estricta y restringida del delito de genocidio en oposición a los principios del Derecho Internacional de los Derechos Humanos y la jurisprudencia de los tribunales especializados de Derecho Internacional Humanitario y Derecho Internacional Penal. En la opinión de la mayoría se antepone la defensa de la soberanía estatal a las obligaciones humanitarias del Estado y la comisión de las más graves violaciones de derechos humanos. En palabras de Cançado Trindade, la razón de Estado privó sobre la razón de Humanidad. Nuestro comentario intenta demostrar que la interpretación del delito de genocidio que realiza la Corte quita a la Convención temática sus efectos apropiados que deben orientarse a la protección de la persona humana.

In its recent judgment on the case “Application of the Convention for the Prevention and Punishment of the Crime of Genocide”, the International Court of Justice missed a historic opportunity to extend the margin of appreciation regarding the protection of individuals and Humanity. The ICJ consolidates a strict and restricted interpretation of the crime of genocide, contrary to the principles of International Human Rights Law and the precedents of the courts specialized in International Humanitarian Law and International Criminal Law. The opinion of the majority the defense of State sovereignty is placed above the humanitarian obligations of the State and gross violations of human rights. In Cançado Trindade’s words, the reason of State (raison d'Etat) prevailed over reasons of Humanity. This paper is intended to demonstrate that the interpretation of the crime of genocide by the ICJ deprives the thematic Convention of its appropriate effects which must be aimed at the protection of the human being.

Na sua recente decisão no caso “Implementação da Convenção sobre a Prevenção e Repressão do Crime de Genocídio”, o Tribunal Internacional de Justiça deixou uma oportunidade histórica para ampliar a margem de apreciação em matéria de protecção da pessoa e site. O Tribunal consolida uma interpretação estrita e rigorosa do crime de genocídio, em oposição aos princípios do Direito Internacional dos Direitos Humanos e a jurisprudência dos tribunais especializados de Direito Internacional Humanitário e Direito Penal Internacional. Na opinião da maioria defender a soberania do Estado às obrigações humanitárias do Estado e à Comissão das mais graves violações dos direitos humanos é invertida. Nas palavras de Cançado Trindade, a razão de Estado privados da razão para a Humanidade.
